{"id":20,"date":"2013-06-25T20:11:28","date_gmt":"2013-06-25T20:11:28","guid":{"rendered":"http:\/\/davidfreedman\/?page_id=20"},"modified":"2026-04-14T18:32:38","modified_gmt":"2026-04-14T18:32:38","slug":"civil-procedure","status":"publish","type":"page","link":"https:\/\/davidfreedman.ca\/?page_id=20","title":{"rendered":"Civil Procedure"},"content":{"rendered":"<p>As you know, <em>litigation<\/em> is a formal process leading to the determination of one or more issues in dispute by a court. The rules which govern the procedures to be followed are sometimes particular to one statute or type of proceeding, but in most private law proceedings it is the general model of procedural law which governs. The general model of procedural law arises from a combination of sources of law &#8211; statute, regulation, equity, and the common law. Our study of the rules of civil procedure will be in relation to Ontario\u2019s main trial court, the <a href=\"https:\/\/www.ontariocourts.ca\/scj\/\">Superior Court of Justice<\/a>, and the rules which govern civil proceedings in that court. Please note that the model of procedural law is quite extensive, and we will not attempt anything like a comprehensive treatment. By the end of the course you should know how to bring a simple matter to conclusion from the time the client steps in the door until the final appeal is determined.<\/p>\n<p>In addition to substantive doctrine, we will also consider how to practice law in this area competently. There are four reasons for inquiring into such matters. First, effective representation is essential to ensure access to justice. Successful litigation practice requires an understanding of the substantive law at issue, procedures for bringing the matter into court, the law of evidence, techniques of advocacy, common sense, and all the intangible skills that are required to play a very elaborate and expensive game (at someone else\u2019s expense). Second, some of the doctrines that are part of procedural law have significance even for those in a solicitor\u2019s or transactional practice (for example, legal professional privilege and the law of limitations). Third, there is self-interest. Litigation retainers produce the second most common area for claims against lawyers for professional negligence according to the latest annual report of <a href=\"https:\/\/www.lawpro.ca\/wp-content\/uploads\/2025\/04\/LAWPRO-Annual-Report-2024-AODA.pdf\">LawPro<\/a>. Many of these claims can be avoided through proper management of litigation files and a recognition that some issues require active management. Last, putting our studies in a practical context will assist you in dealing with the admission exams that you must pass in ordered to become licensed by the Law Society of Ontario.<\/p>\n<p><strong><em>Classes: <\/em><\/strong>Monday &amp; Wednesday, 11:30am-1:00pm, Dunning 11<\/p>\n<p><strong><em>What materials are required for this course? <\/em><\/strong><\/p>\n<p><strong><em>Primary Materials: <\/em><\/strong>there is no casebook to purchase. On the final examination, I will assume that you have access to the materials assigned whether in digital form or in hardcopy (the choice is yours). The best of the lot for our purposes is <a href=\"https:\/\/store.lexisnexis.ca\/en\/categories\/shop-by-jurisdiction\/ontario-10\/morden-perell-the-law-of-civil-procedure-in-ontario-4th-edition-student-edition-skusku-cad-00842\/details\">Morden &amp; Perell, <em>The Law of Civil Procedure in Ontario<\/em>, 5<sup>th<\/sup> Edition<\/a> ($145 to purchase the student edition; online for free via <a href=\"https:\/\/library.queensu.ca\/search\/database\/lexis-premium\">Lexis Advance Quicklaw<\/a>). There is also an online reference work available through CanLII,\u00a0<a href=\"https:\/\/www.canlii.org\/en\/commentary\/81787\/\"><em>Civil Procedure and Practice in Ontario, 2nd Edition<\/em><\/a><em>. <\/em>There are many other <a href=\"https:\/\/guides.library.queensu.ca\/civil-procedure\">reference works available to you in the library and online<\/a> at no charge.<\/p>\n<p><strong><em>How to approach the reading?<\/em><\/strong><\/p>\n<p>I\u2019m not particularly fond of the casebooks that are available (and they are very expensive) and would prefer to assign case reports. Many of the cases assigned deal exclusively with a procedural point and are short; others are trial or appeal decisions that deal with many issues, only some of which are procedural. For those longer and more involved judgments, please just stick to the relevant procedural law (and usually the underlying facts are not all that important). The next stage deals with bringing the proposals into final form (a decision for the Minister) and then implementation.<\/p>\n<p>The Working Group submitted its <a href=\"https:\/\/www.ontariocourts.ca\/scj\/files\/pubs\/2025-12-15-final-policy-proposal.pdf\">Final Report<\/a> to the Attorney General and Chief Justice of Ontario at the end of October and it was posted online on December 19, 2025. This was the completion of the second stage of the review process. The proposed changes will necessitate an overhaul of the present Rules, and it is expected that the revised Rules will be released mid-2026 (or later) with a view to implementation by January 1, 2027. The main changes are in respect of Discovery, which will largely be eliminated, and mandatory document exchange at the commencement of most proceedings &#8211; but there will be changes to a number of other areas as well and a fair amount of fine-tuning the existing model (if approved).<\/p>\n<p>Once there is greater clarity, the readings may be revised to suit. On the whole, we will stick to basic considerations that are present in the existing law and will remain in existence in the proposed reforms for the purposes of assessment.<\/p>\n<hr \/>\n<p style=\"text-align: center;\"><strong><u>TOPICS &amp;
