An \u2018estate\u2019 is a legal term to describe the deceased\u2019s obligations, assets and debts. The estate needs to be <em>administered<\/em>; someone must actually do the work of paying the outstanding debts, collecting debts owed to the deceased, filing taxes, and finally distributing the deceased\u2019s property according to a Will that the deceased made or the rules that apply to divide the estate where there is no will.<\/p>\n<p>The most common types of litigation that arise in such circumstances include:<\/p>\n<ul>\n<li><strong>Will contests<\/strong>, to determine is a will is valid or which will should be used to administer the estate if there is more than one will.<\/li>\n<li><strong>Will interpretation<\/strong> questions.<\/li>\n<li><strong>Complaints against one or more estate trustees<\/strong> (\u2018executors\u2019), that might require a Court to intervene.<\/li>\n<li><strong>Disputes about how the estate trustee has used the assets of the estate<\/strong> or proposes to compensate himself or herself.<\/li>\n<li><strong>Disputes over whether property is owned by the estate or someone else<\/strong> (especially jointly held property like a joint bank account).<\/li>\n<li><strong>Life insurance claims, RRSP designations<\/strong>, and other such \u2018will-substitutes\u2019.<\/li>\n<li><strong>Dependant\u2019s Support claims<\/strong>, where the deceased is said to have left inadequate support for someone entitled to support from the estate.<\/li>\n<li><strong>Issues involving the use of a Power of Attorney<\/strong> involving the deceased&#8217;s property.<\/li>\n<\/ul>\n<p>I have experience in all of these areas and would be pleased to be of assistance.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>When a person dies, they leave behind their \u2018estate\u2019.
